"Livin' La Vida Local" Promotion 

 

Terms and Conditions

  1. Langmeil Pty Ltd (ABN 44 073 327 643) is the promoter (Promoter) of the competition called "Livin' La Vida Local" as described on the website http://www.langmeilwinery.com.au/Livin-La-Vida-Local (Competition).
  2. Information on how to enter the Competition forms part of these terms and conditions. By entering the Competition you are deemed to have accepted these terms and conditions. The Competition is a game of chance and skill plays no part in determining the winner.
  3. Entry is open to all residents of Australia. Employees of the Promoter and their immediate families and the Promoter's associated agencies and companies are not eligible to enter.
  4. The Competition commences on 14 July 2014 at 00:01 (AEST) and concludes on 1 September 2014 at 12:00am (AEST) (Promotional Period).
  5. It is a condition of entry that all entrants are over the age of 18 upon the date of entry. Any entry in contravention of these terms and conditions will be void.
  6. Each entrant will receive one entry in the Competition for completing either of the following activities:
    1. Registering their contact details including (but not limited to) name, phone number, postcode and email address at www.langmeilwinery.com.au or the promotional web link provided; or
    2. Updating their contact details already registered with the Promoter at www.langmeilwinery.com.au or the promotional web link provided.
  7. In addition, all entrants will receive one bonus entry each time they Purchase a carton of wine from the www.langmeilwinery.com.au website.
  8. There is no limit on the number of bonus entries each entrant may receive during the Promotional Period.
  9. Incomplete, incomprehensible and illegible entries will be deemed invalid.
  10. The winner must be able to travel to South Australia between 1 November 2014 and 1 December 2015.
  11. The Promoter reserves the right to request the winner to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of satisfaction of any other entry conditions in order to claim a prize. The Promoter will decide, in its discretion, whether the provided proof is suitable. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  12. The Promoter reserves the right to verify the validity of entries and to disqualify any:
    1. entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, discriminatory, inflammatory or defamatory statements; and
    2. entrant who:
      1. tampers with the entry process;
      2. submits an entry that is not in accordance with these terms and conditions; or
      3. has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.
  13. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  14. Entries must be received by the Promoter by the expiry of the Promotional Period for the entry to be included in the draw. The time of entry will be the time the registration data is received by the Promoter. The Promoter accepts no responsibility for any late, lost or misdirected entries not received by the Promoter or delays in the delivery of data due to technical disruptions, network congestion or for any other reason.
  15. The cost of accessing the Promoter's website is dependant on the entrant's individual Internet Service Provider and will be borne by the entrant.
  16. The prize includes the following for four people:
    1. subject to clause 19, economy airfares from any capital city in Australia to and from Adelaide on the Promoter's choice of carrier;
    2. connections to and from Adelaide International Airport to the Promoter's premises;
    3. the reasonable cost of meals and drinks packages described in the Prize summary published on the Promoter's website;
    4. 4 nights accommodation in a cottage on the Promoter’s premises:
      1. The following activities will also be arranged by the Promoter:
      2. an orientation day at the Promoter’s premises, including a presentation about the history of the Promoter and the region;
      3. harvest related activities suitable for someone with no prior viticultural experience;
      4. trivia night;
      5. winemaking activities suitable for someone with no oenology experience;
      6. tour of the Barossa valley region, including a selection of food producers, markets and wineries in the region; and
      7. golf (optional)
    5. a donation of approximately $1,000 worth of wine to a charity of the winner's choice (made up of bottles totalling two dozen or less),(together the Prize).
  17. If one of the winner’s guests is under the age of 18, they must be accompanied by a guardian who is either the winner or a winner’s guest. The guardian must be responsible for the minor at all times.
  18. The value of the Prize is valued at up to AU$10,000 including GST. This value is based on the price of standard airfares from Perth to Adelaide. Prize values are based upon the recommended retail prices at the commencement of the Promotional Period (inclusive of GST). The Promoter accepts no responsibility for change in Prize value between now and the ultimate Prize redemption date.
  19. If the winner resides within South Australia, the airfare component of the prize will be forfeited and will not be redeemable for cash.
  20. The itinerary is to be determined by agreement with the winner but in the event that agreement is not reached, the Promoter reserves the right to determine the itinerary.
  21. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the Prize, if the Promoter determines in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in th Prize (or any aspect of the Prize).
  22. It is a condition of accepting the Prize that:
    1. if deemed necessary by the Promoter, the winner sign a legal release in a form determined by the Promoter in its absolute discretion; and
    2. the winner must comply with all conditions of use of the Prize including any reasonable directions or requirements of the Promoter.
  23. Once Prizes have left the Promoter's premises (if applicable), the Promoter takes no responsibility for Prizes damaged, delayed or lost in transit.
  24. By accepting the Prize, the winner agrees to participate in and co-operate as required with all reasonable media or editorial requests relating to the Prize, including but not limited to, being interviewed, photographed, filmed and/or chaperoned throughout the duration of the Prize.​
  25. In consideration for the Promoter awarding the Prize to the winner, the winner hereby:
    1. a. assigns to the Promoter all right, title and interest in and to all copyright in any material created by the winner as a result of the winner's participation in any aspect of the Prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee or other consideration for such use;
    2. b. agrees that the Works may be used with any modification the Promoter chooses in its discretion and with or without attribution of the winner; and
    3. c. permits the winner's image and/or voice, as recorded, photographed or filmed during the winner's participation in the Prize to appear in connection with the Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee or other consideration for such use.
  26. In the event that, for any reason whatsoever, a winner does not claim or participate in an element of the Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.
  27. Each valid entrant who has entered the competition over the duration of the Promotional Period will be entered into the draw. Each entry gives rise to an equal chance of winning the Prize. The draw will take place on 1 September 2014 at 12 noon (AEST) at the Promoter's premises at the Corner of Langmeil Road and Para Road, Tanunda (Promoter's Premises). The first valid entry drawn that complies with these terms and conditions will be the winner of the Prize.
  28. The winner will be notified by email within 7 days of the Prize draw. The name of the winner will be published on the website www.langmeilwinery.com.au on the 7th of September 2014.
  29. Should an entrant's contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
  30. If required, an unclaimed prize draw will take place at the Promoter's Premises on 1 December 2014. The replacement winner of the Prize will be notified by email within 7 days of the unclaimed prize draw. The replacement winner will have their details published on the website, www.langmeilwinery.com.au on 8 December 2014.
  31. The Promoter's decision is final and the Promoter will not enter into correspondence regarding the Competition result.
  32. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same or varied conditions, subject to any written directions given by a regulatory authority.
  33. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any Prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information caused by any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries by third parties.
  34. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter reserves its legal rights to recover damages or other compensation from such an offender.
  35. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given by a regulatory authority.
    1. Personal Information Collection Statement
  36. The Promoter collects your personal information for the purpose of conducting and promoting the Competition and to add such personal information to our mailing list. We will use your personal information for the purposes of direct marketing and by providing us with your personal information you consent to us doing so. However, if you do not wish to receive marketing or promotional communications from us, please notify us or use the opt out mechanism provided in those communications.
  37. We may be unable to enter you into the Competition or notify you if you win the Competition if you do not provide the personal information we request.
  38. We will disclose your personal information to certain contractors and suppliers of elements of the Prize. Certain legislation (eg, Lottery and Gaming Act 1936 (SA)) requires us to disclose your personal information to certain entities such as State regulatory authorities and State Ministers. Generally we are not likely to disclose your personal information to overseas recipients.
  39. Our Privacy Policy (accessible on our website at http://www.langmeilwinery.com.au/Privacy-Policy) contains information about how you may access your personal information held by us and seek correction of such information. It also contains information about how you may complain about a breach of the Australian Privacy Principles and how we will deal with such a complaint.
